These General Terms and Conditions (hereinafter referred to as “Terms and Conditions”) of Kukz Design s.r.o. with its registered office at: Nádražní 266, Pernink 362 36, Czech Republic, identification number 25236083, entered in the Commercial Register kept at the Regional Court in Plzen, Section C, Insert 11375 (hereinafter referred to as the “Seller”) No. 89/2012 Coll., Civil Code, as amended (hereinafter the “Civil Code”) mutual rights and obligations of the parties arising in connection with or on the basis of a purchase contract (hereinafter the “purchase contract”) concluded between the seller and another by a natural person (hereinafter referred to as the “Buyer”) through the seller’s online store. The internet shop is operated by the seller on a website located at the internet address http://kukz.eu (hereinafter referred to as the “website”).
In order to purchase Goods on this Website and to use the enquiry form facilities you are required to create an Account which will contain certain personal details and Payment Information which may vary based upon your use of the Website as we may not require payment information until you wish to make a purchase. By continuing to use this Website you represent and warrant that:
all information you submit is accurate and truthful;
you have permission to submit Payment Information where permission may be required; and
you will keep this information accurate and up-to-date.
The seller may cancel the user account, especially if the buyer does not use his user account for more than 12 months, or if the buyer violates its obligations under the purchase agreement (including business conditions).
All products are made to order. Lead time depends on the workload.
By completing and submitting the electronic order via this website you agree to these terms and conditions.
By completing and submitting the electronic order you are making an offer to purchase goods that, if accepted by us, will result in a binding contract. A binding contract will only result when we have notified you that your goods have been despatched.
In the event Kukz Design s.r.o. declines your order we shall provide you with a full refund.
Once an order has been despatched we cannot change the delivery address from that originally stated on the order.
In accordance with Section 2132 of the Civil Code, the Buyer acquires the ownership rights to the delivered goods only after the purchase price for the Goods has been paid in full.
If Goods are being ordered from outside KukZ Design’s country of residence, import duties and taxes may be incurred once your Goods reach their destination. KukZ Design s.r.o. is not responsible for these charges and we undertake to make no calculations or estimates in this regard. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. As the purchaser of the Goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Goods may be inspected on arrival at port for customs purposes and Baking Deco cannot guarantee that the packaging of your Goods will be free of signs of tampering.
The Seller reserves the right to change the price of the Goods and Services. The price valid at the time the Order is placed (i.e. the current price specified at that time on the Seller’s website) remains valid until such time that the Purchase Agreement is made.
The Seller will notify you when your goods are to be dispatched to you.
The Seller arranges for the worldwide shipment of the goods. The packing and shipping costs are fully borne by the Buyer.
The delivery will be considered to have been completed at the time the goods are delivered to the address specified in the Order.
If the Seller receives no communication from you, within 3 days of delivery, regarding any problems with the Goods, you are deemed to have received the Goods in full working order and with no problems.
We make every effort to deliver goods within the estimated time scales. Please be aware that delays are occasionally inevitable due to busy periods and unforeseen factors.
The Seller not be held responsible for delivery delays beyond our reasonable control, for example: strike action, 3rd party delays, traffic or weather constraints and therefore will not accept liability for late delivery under these circumstances.
Transport method is Czech Post (delivery timeframes according to the destination country).
KukZ Design s.r.o aims to always produce high quality Goods.
On occasion however, goods may need to be returned. Returns are governed by these Terms and Conditions.
If you receive Goods which do not match those that you ordered, you should contact us by email: info@kukz.cz
You will be given the option to have the Goods replaced with those ordered or to be refunded through the payment method used by you when purchasing the Goods.
If Goods are damaged in transit and the damage is apparent on delivery, you should sign the delivery note to the effect that the goods have been damaged. The price of the Goods, as paid by you, will be refunded to you through the payment method used by you when purchasing the Goods.
If you have not received your parcel within 60 working days, we will arrange a replacement or full refund in the event the goods cannot be found.
KukZ Design s.r.o cannot be held liable for lost or damaged parcels where the customer supplies incorrect or insufficient address details provided on your order.
You may return unwanted goods for a full refund of the original paid amount at any time within 14 days, starting the day after receipt of your goods. Exceptions to this are listed below.
KukZ Design s.r.o. will not refund mailing costs incurred in returning the goods. Goods must be returned to us in an “as new” re-saleable condition. It is advisable to use a recorded delivery service, or at a minimum obtain a proof of posting at the post office in the unlikely event the goods are lost in transit.
